Terms of Service (EULA)

Article 1 (Scope & License)

1. These Terms of Service ("Terms") govern your use of UkuleleKun & AcogiKun ("Service"). By using the Service, you agree to these Terms.

2. These Terms constitute a contract between you and the operator of the Service ("Operator"). Apple Inc. ("Apple") is not a party to this contract.

3. The Operator grants you a non-transferable, non-exclusive right to use the Service on iOS devices you own and manage, in accordance with these Terms. This right may not be sublicensed, transferred, or lent.

4. You represent and warrant that you (i) do not reside in a country subject to U.S. government sanctions or designated as a "state sponsor of terrorism," and (ii) are not listed on any U.S. government export restriction or denial list.

Article 2 (Registration & Account)

Registration may be required to use the Service. You must provide accurate information and promptly update it if anything changes.

Article 3 (Prohibited Conduct)

Users must not engage in any of the following:

• 1. Acts that violate laws, court judgments/decisions/orders, or public order
• 2. Acts that interfere with the operation of the Service or impose excessive burden on the infrastructure
• 3. Acts that inconvenience or infringe the rights of other users or third parties
• 4. Unauthorized analysis, reproduction, repurposing, or reverse engineering of Service content and programs
• 5. Unauthorized access or other fraudulent acts

Article 4 (Paid Plans & Auto-Renewable Subscriptions)

Article 5 (Disclaimer & Liability Cap)

1. The Operator makes no warranties, express or implied, regarding the accuracy, completeness, usefulness, or fitness for a particular purpose of the Service (including provided chord data and auto-generated content).

2. For damages caused to the user by the Operator's negligence (excluding gross negligence) or force majeure, the Operator's liability is capped at the total fees paid by the user in the most recent one month.

3. Data backup is your responsibility. The Operator is not liable for any data loss or alteration.

4. The Operator is not liable for any copyright disputes or other conflicts arising from secondary use (posting to social media, distributing to third parties, disseminating images or screenshots, etc.) of data created, output, or saved using the app.

5. Under App Store EULA requirements, the Operator, not Apple, is responsible for maintenance, support, bug fixes, and serves as the primary contact for claims regarding third-party intellectual property infringement.

Article 6 (Changes to Terms)

The Operator may change these Terms without prior notice when deemed necessary. Changes take effect upon posting to the Service.

Article 7 (Copyright and Responsibility for Data Sharing)

1. 1. The "PDF/Image Chord Reading feature" provided by this Service is intended for use within the scope of "reproduction for private use" under copyright law, such as analyzing sheet music that the user legitimately owns.
2. 2. Users shall not upload or input files that infringe upon the copyright, portrait rights, or other intellectual property rights of third parties (including commercially available sheet music, lyric data, and images whose public transmission is prohibited).
3. 3. Responsibility for the sending and receiving of data between users (including but not limited to sharing features such as "Score Share" and "Score Receive") shall be borne entirely by the users themselves. The input, uploading, and distribution of lyrics or score data that infringe upon the copyrights of others, as well as distribution to unspecified parties or groups without the permission of the rights holder, are strictly prohibited.
4. 4. The Service (operator) shall bear no responsibility for copyright disputes or other disputes between users or with third parties arising from data that users upload, input, or share through this Service. Such matters shall be resolved at the user's own expense and responsibility.
5. 5. If illegal data sharing, copyright infringement, or any violation of these Terms is discovered, or if the operator determines that there is a risk of such acts, the operator may, without prior notice, take measures including deletion of the relevant data and suspension of the user's account (including account deletion).

Article 8 (Governing Law & Jurisdiction)

These Terms are governed by Japanese law. Any disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location.

Article 9 (Third-Party Beneficiary)

You and the Operator agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your agreement to these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
